Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the recruiting and workforce platform provided by Militia Marketing (“Militia Marketing,” “we,” “us,” or “our”) (the “Service”). By accessing the Service, submitting an application, or creating an account, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is true, accurate, and complete.

2. The Service

The Service lets you apply for opportunities, communicate with us, and — if you are engaged — complete onboarding, training, scheduling, and related workforce tasks. We may add, change, or remove features at any time.

3. No offer or guarantee of engagement

Submitting an application or using the Service does not create any employment, contractor, agency, or partnership relationship, and is not a promise of work, an offer, or a guarantee of any role, compensation, or outcome. Any engagement is subject to a separate written agreement, and the nature of that engagement (including any independent-contractor relationship) is defined solely by that agreement.

4. Accounts and security

If you are issued an account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or legal risk.

5. Acceptable use

You agree not to:

  • Submit false, misleading, or fraudulent information, or impersonate another person;
  • Upload content you do not have the right to share, or that is unlawful, infringing, or harmful;
  • Attempt to access accounts, data, or systems you are not authorized to access;
  • Probe, scan, or test the vulnerability of the Service, or circumvent its security or rate limits;
  • Introduce malware or interfere with the operation of the Service; or
  • Use the Service to violate any applicable law or the rights of others.

6. Your content

You retain ownership of the information and documents you submit. You grant us a non-exclusive license to use, store, and process that content as necessary to operate the Service and evaluate, onboard, and (where applicable) engage you. You are responsible for the accuracy of what you submit.

7. Background checks and consents

Certain roles require a background check and your separate written authorization. Your privacy choices, SMS consent, and our data practices are described in our Privacy Policy and SMS Terms, which are incorporated into these Terms.

8. Intellectual property

The Service, including its software, design, and content (excluding your own submissions), is owned by Militia Marketing or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service except as permitted by law.

9. Third-party services

The Service relies on third-party providers (for example, hosting, email, SMS, and background screening). We are not responsible for the acts or omissions of third parties, and your use of their services may be subject to their own terms.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILITIA MARKETING AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless Militia Marketingand its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms. Provisions that by their nature should survive termination will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The parties agree to the exclusive jurisdiction of the state and federal courts located in Texas for any dispute not subject to arbitration. (If you intend to require arbitration or a class-action waiver, that language must be added here and reviewed by counsel.)

15. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
